Terms of Use

1. Acceptance of Terms

The present Terms and Conditions of Use (the "Terms") are applicable to the Mekco Supply mobile application (the "App") and website (the "Website") operated and managed by Mekco Supply Inc. and its subsidiaries or affiliated companies (collectively, "Mekco Supply," "we," "our," or "us").

By accessing, browsing, and/or using the App or Website, you acknowledge that you have read, understood, and accepted all of these Terms. If you do not agree to these Terms, you may not use the App or Website or any of its functionalities.

2. Account Creation

A. Required Information

To create an account, you must provide:

• Email address
• Phone number
• First name
• Last name
• Password

You may also optionally provide:

• Profile image
• Receipt email (for Apple Private Relay users)

B. Account Responsibilities

You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the confidentiality of your password
• Be responsible for all activities that occur under your account
• Notify Mekco Supply immediately of any unauthorized use of your account
• One account per person (no multiple accounts)

3. Data Collection

By using the App, you consent to our collection and use of your information as described in our Privacy Policy. We collect the following information:

A. Account Information

• Email address (required)
• Phone number (required)
• First name (required)
• Last name (required)
• Password (encrypted, required)
• Profile image (optional)
• Receipt email (optional)

B. Order Information

• Billing address (required for delivery orders)
• Shipping address (optional)
• Company name (optional)
• Order notes (optional)
• Payment information (processed via PayPal - third party)

C. Order History

• All past orders and order details
• Order status and fulfillment information

D. Warranty Claims

• Product information
• Receipt images
• Product photos
• Digital signatures
• Claim notes

E. Technical Data

• Device information (iOS/Android, app version)
• IP address (for server logs and security)
• Authentication tokens (stored securely on device)

This data is collected for the purposes of account management, order processing and fulfillment, payment processing, customer service, warranty processing, communication, app functionality, security, and legal compliance. For detailed information, please see our Privacy Policy.

4. Order Terms

A. Order Acceptance

All orders are subject to acceptance by Mekco Supply. Orders are binding once accepted. We reserve the right to refuse or cancel any order for any reason.

B. Payment Terms

• Payments are processed via PayPal (third party)
• Currency: Canadian Dollars (CAD)
• Payment is required before order fulfillment
• All prices are subject to change without notice
• All taxes, shipping costs, and fees are in addition to quoted prices

C. Fulfillment

• Store Pickup: Currently available. Orders ready in 2-4 hours.
• Home Delivery: Coming soon (currently unavailable)

D. Cancellation and Returns

Orders may not be cancelled or modified without written consent from Mekco Supply. Special order items may not be cancelled or returned. Returns are subject to our return policy. Please contact customer service for return requests.

5. User Responsibilities and Prohibited Activities

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to the App or systems
• Interfere with or disrupt the App's functionality
• Use automated systems to access the App without permission
• Impersonate any person or entity
• Collect or harvest information about other users

6. Account Deletion

You may delete your account at any time:

1. Open the App and navigate to the Profile screen
2. Scroll to the bottom and tap "Delete Account"
3. Confirm the deletion in the warning dialog

What happens when you delete your account:

• All personal information (email, phone, name, profile image) will be permanently deleted
• You will be immediately logged out
• Order history may be retained in anonymized form for business and legal purposes (tax records, warranty claims)
• This action cannot be undone

7. Intellectual Property

All content on the App and Website, including but not limited to text, images, illustrations, software, HTML code, audio clips, and video clips, is owned by Mekco Supply Inc. The material is protected in Canada by the Copyright Act and in other jurisdictions by applicable international treaties and local legislation.

You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any content without our prior written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEKCO SUPPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Product warranties are manufacturer warranties. Mekco Supply disclaims all warranties, express or implied, regarding products sold.

9. Disclaimer

While Mekco Supply may update information on the App and Website from time to time, we do not represent or warrant that information is up-to-date, accurate, error-free, or complete. The App and Website are provided "as is" without warranties of any kind.

10. Links to Third-Party Services

The App may contain links to third-party services (such as PayPal for payment processing). We do not endorse or assume responsibility for third-party services. Your use of third-party services is subject to their terms and privacy policies.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Notifying you through the App (for significant changes)

Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and delete your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
